The founding fathers created the U.S. Constitution in order to provide a framework under which the national and state-level governments could operate. Included in the U.S. Constitution is the Bill of Rights (the first 10 amendments). The Bill of Rights documents certain individual and state rights.
Please review the Bill of Rights (found under the link to the US Constitution in the Module 1 course materials). Once you have completed your review please identify and discuss which amendment you feel is most important to the modern criminal law process. How does the amendment impact the daily activities of law enforcement, prosecutors, and the court? When structuring your response please attempt to identify specific examples (such as prior U.S. Supreme Court decisions or current events impacting the U.S. Criminal Justice System) to support your argument. (You can identify examples from your course readings or other academic resources. Please be sure to properly cite your academic resources in your response. This citation requirement will be true for all posts to the discussion board throughout the semester.)
I think you could potentially argue for more than one amendment. As a result, please try to make your response as persuasive and detailed as possible. One thing we will learn about the law is that the manner in which you articulate your argument can often impact the outcome. You should phrase your answer to convince your fellow classmates (and the professor) that your selected amendment is superior to the rest when it comes to issues of criminal law. You should thoroughly explain your reasoning for full credit.
